Rapid Response | Plan if Rosenstein (or Mueller) is Fired

UPDATE 11/8/18

JOIN SCI TO PROTEST, THURSDAY 11/08 @4PM AT THE SANTA CRUZ COURT HOUSE ON OCEAN ST.

As you know, Attorney General Jeff Sessions was forced out.

In his place, Donald Trump has decided to appoint a partisan loyalist who has published op-eds slamming Special Counsel Robert Mueller’s investigation.

What’s more, The Justice Department says acting Attorney General Matt Whitaker will immediately take over supervising special counsel Robert Mueller’s Russia investigation from Rod Rosenstein, the embattled deputy attorney general.

The red line has been crossed. In response, the Trump is Not Above the Law coalition is calling for nationwide rapid response protests tomorrow—Thursday, November 8— at 4pm local time at the Santa Cruz County Courthouse in Santa Cruz on the steps facing Water Street. Please do not block traffic or impede activities of the County Building.

Let’s be clear: Matt Whitaker cannot have oversight of the Russia investigation, and must allow the investigation to continue.

Santa Cruz Indivisible has created a  Santa Cruz specific Action Plan for Thursday 11/08, which includes the protest location on the Water St. side of the Santa Cruz Court House.

Donald Trump could be preparing to put himself above the law. We won’t allow it.

Trump will create a constitutional crisis if he fires special counsel Robert Mueller or Deputy Attorney General Rod Rosenstein, who oversees Mueller, or attempts to compromise the investigation by other means. (See The Plan for details.)

Our response in the hours following a potential power grab will dictate what happens next—whether Congress will stand up to Trump or allow him to move our democracy toward authoritarianism.

That’s why we’re preparing to hold emergency “Nobody Is Above the Law” rallies around the country, in the event they are needed—900+ of them and counting, in every state, with 350,000 RSVPs to date!

UPDATE 9/26, 8:30 PDT – Key updates from MoveOn

  1. Possible Thursday launch

Donald Trump is scheduled to meet with Rod Rosenstein on Thursday. It’s possible that this meeting concludes with Trump firing Rosenstein—though anything could happen, and we wouldn’t launch until we were certain a red line has been crossed. We need to be alert Thursday as news emerges from the meeting. And also be careful about uncorroborated reports—Monday morning being a great example of how newspapers can misreport in efforts to be the first to publish a story.

  2. Rosenstein firing = protests. Rosenstein resignation = no protests.
We discussed the various scenarios that could unfold at Thursday’s meeting (or anytime before/after). The Nobody Is Above the Law coalition has determined that a resignation by Rod Rosenstein would not constitute Trump’s crossing a red line, because it’s would not be an action Trump would have taken. However, if Donald Trump fires Rosenstein but tries to depict it as a resignation, we will treat that for what it really is: Trump crossing the red line. If this week is any indicator, there may be some uncertainty and debate about these important facts in the moment, so we will try to make a call only once the true nature of a possible Rosenstein departure is clear.
  3. An additional red line: Mueller report suppressed … or finds crimes
Special counsel Mueller’s team has been working for well over a year. While the investigation is not on a specific timeline, it is important to be prepared for the release of the investigation’s findings. When we come to this critical point in the investigation, the threat to its integrity will be all the greater. Here is an additional red line that would trigger the rapid response-network: The Mueller investigation releases findings showing significant wrongdoing by Donald Trump. Or Congress or the administration blocks the public from seeing Mueller’s findings. This would be in addition to the current red lines: firing Mueller, firing Rosenstein, pardoning key witnesses.

UPDATE, 9/24, 12:43 PM EDT
— The news about Rod Rosenstein’s status as Deputy Attorney General is very fluid. There are conflicting reports on whether he remains in his position overseeing the Mueller investigation or has been fired. The Nobody Is Above the Law network is on high alert — but we’re NOT activating national protests as of now.
— The coalition supporting these grassroots events, including @Public_Citizen @michael_moveon @indivisibleteam @standupamerica @commoncause @MarchForTruth17 & @sierraclub, will sound alarm if needed.
— These events will be triggered by red lines including Rosenstein being fired or forced out.
— Make sure you’re signed up for your closest event to receive breaking updates.
